The website for the AT&T Mobility Settlement lawsuit is www.ATTMSettlement.com. The lawsuit claims that AT&T Mobility charge taxes, fees and surcharges on internet access which is in opposition to the Internet Tax Freedom Act, 47 U.S.C. § 151 (1998) (as amended) and other state laws. The services provided include iPhone data plans, Blackberry data plans, other smart phone data plans, laptop connect cards and pay-per-use data services.

The lawsuit alleges that AT&T Mobility is likely for damages to the Class. If you have paid any of these surcharges for internet access from November 1, 2005 to September 7, 2010 then you are a part of the AT&T Mobility Class Action Lawsuit Settlement. If you are a part of the AT&T Mobility Class Action Lawsuit Settlement, then you can decide to be excluded from the settlement or you can make an objection. To exclude yourself from the class you have to stipulate that in a letter to be postmarked before or on Feb 2 2011 to ATTM Settlement Administrator whose address can be found on attmsettlement.com. If you choose to do nothing, then you will get the settlement benefits as AT&T will be able to identify the consumers who were assessed this Internet taxes and the Settlement Administrator will then issue a check to the most recent address.
The three main benefits that you will get as a class member of the AT&T Mobility settlement are: first, AT&T Mobility will discontinue collecting taxes on internet access unless state laws change and permit or require them to do so, second, AT&T Mobility will prepare and process tax refund claims looking for a refund of the internet taxes they collected from the class members and paid to the taxing jurisdictions, third, AT&T Mobility will pay class members any vendor’s compensation they received, which is the amount of money AT&T Mobility was permitted to retain from the sales tax it collected as compensation for collecting the taxes for some taxing jurisdictions.
You would get the benefit when the Court will hold a hearing on March 10, 2011, to make a decision whether to approve the Settlement. The Settlement Administrator will send out the benefits once money is received from the taxing jurisdictions to which your payments to AT&T Mobility were remitted as soon as the Settlement is approved and all appeals have been resolved.
You have four options for Settlement:
- Exclude yourself and get no benefit. This is the only option that allows you to ever be part of any other lawsuit against AT&T Mobility about the legal claims in this case.
- Write to the Court about why you don't like the Settlement.
- Ask to speak in Court about the fairness of the Settlement.
- Do nothing. Receive the Settlement benefits. This will end any further claims against ATT Mobility for the charging of taxes as claimed in the lawsuit.
